1. Scope & Provider Information

These Terms and Conditions apply to all offers, orders, and sales agreements concluded between 42112757 ("we", "us", or "the Seller") and consumers or businesses ("Customer" or "you") through our online store.

2. Product Characteristics & Boutique Media Specifics

We specialize in imported, collectible, and boutique physical media (including limited-edition 4K UHD, Blu-ray discs, Digipaks, and SteelBooks).

  • Sealed Collector Goods: Unless explicitly described otherwise in the product title or listing description, all physical media items are factory-sealed in their original manufacturer shrink-wrap.
  • Format & Region Compatibility: The customer is solely responsible for verifying hardware playback compatibility (such as 4K UHD region-free standards, Blu-ray Region A/B/C codes, or disc player capabilities) as stated in the item description prior to completing a purchase.

3. Order Conclusion & Payment

  • A binding purchase contract is formed when you complete the checkout process and receive an automated order confirmation email from our store.
  • We accept payment via the certified third-party payment gateways integrated at checkout (including Stripe, Credit/Debit Card, Apple Pay, iDeal, and PayPal).
  • Orders will not be dispatched until payment authorization has been fully verified and received.

4. Pricing, Currency & VAT

  • All prices in the store are displayed in Euros (€) and include statutory Dutch VAT (BTW) where applicable under European Union value-added tax rules.
  • Shipping costs are clearly calculated and displayed separately during checkout before you finalize payment.
  • For shipments within the European Union (including Germany), prices are free from additional import customs duties or cross-border clearance tariffs.

5. Delivery, Fulfillment & Risk of Loss

  • Orders are packaged using protective collector-grade materials (rigid cardboard and bubble wrap) and dispatched within 1 to 2 business days.
  • Transit is handled via tracked postal or courier services (DHL eCommerce / PostNL). The tracking code is transmitted to the customer upon dispatch.
  • In accordance with consumer protection provisions under Dutch and European consumer law, the risk of transit loss or damage remains with the Seller until the physical goods are handed over to the customer or an authorized recipient at the specified delivery address.

6. Statutory Right of Withdrawal & Physical Media Exception

Customers residing in the European Union hold a statutory right to withdraw from this contract within 14 calendar days from the day of delivery without providing a reason.

Statutory Sealed Media Exception (Article 16(i) EU Directive 2011/83/EU / Art. 6:230p sub f Dutch Civil Code):

The right of withdrawal does not apply to, and expires immediately for, the supply of sealed audio or sealed video recordings (including 4K UHDs, Blu-rays, and SteelBooks) if the factory shrink-wrap, protective film, or manufacturer security seal has been unsealed, broken, or removed after delivery.

  • To exercise a withdrawal on an unopened, intact, factory-sealed item, you must notify us in writing at themovieshelfimports@gmail.com within 14 days of delivery.
  • The customer must return the item in its original protective packaging via a tracked shipping method. In accordance with EU law, the customer bears the direct return postage costs unless the return is due to an error on our part.

7. Conformity & Statutory Warranty

Under European consumer law, statutory legal warranty rights apply to all physical items sold. If an item arrives physically defective (e.g., defective disc pressing playback confirmed upon delivery), the customer is entitled to free repair, replacement, or a refund pursuant to Dutch and EU warranty regulations.

8. Applicable Law & Dispute Resolution

  • These terms and all sales contracts are governed exclusively by the laws of The Netherlands, without prejudice to mandatory statutory consumer protection laws of your country of residence within the EU.
